Simple Theme Jquery

When implementing the latest responsive bx slider in the simple theme, there are a few issues with the jquery.
The theme currently uses jquery-1.7.2.js, has anyone managed to get it working in 1.8.2/jquery.min.js or higher?
as the responsiveness of the slider does some strange things, like stops working once you start resizing the browser etc
